A QUICK GUIDE TO TITLE

Most people are unfamiliar with title insurance before they become homeowners. Put simply, title insurance protects homeowners and lenders against claims that the property is not rightfully owned by the buyer.

When an order is opened, a title agent like Avalon will run a title search which should surface all documents related to the property that have been recorded in the municipal records where the property is located. Once the search comes back, the property records are examined to determine whether any liens, encumbrances, or other issues exist that could impact the homebuyer’s ownership in the property if not taken care of prior to closing. For example, a prior mortgage that belongs to the seller or an issue related to a probate proceeding may call the homebuyer’s complete ownership of the property into question.

After the property’s title is examined, a title commitment is prepared and issued to the homebuyer and the lender (if there is one). A title commitment is a promise by a title underwriter (which provides the actual title insurance policy) to provide protection to the homebuyer and the lender if a title issue does arise after closing, so long as certain requirements are met.
